My husband was placed on child support when we separated and I needed to file for medicaid for my children. He was charged an amount of $609 monthly because he never showed up to a court hearing and provided his income information which at the time he was being supported by his mother. Later a judgment was filed against him by the court. We reconciled and her moved back to NY and contacted the child support courts to set up a meeting to explain that he was never employed during the time he was being charged child support. He provided proof of and the suspension was lifted off of his license. A new court date was set because my husband still had the owed child support judgment that was in his name and now that he found a job the courts were taking out the $609 monthly from his checks which was more than half of his check. He went to his court date with all of his proof and the payment for the owed child support was brought down to $56 weekly from his check. Whats still, happening is that my husband IRS tax returns are still being intercepting by a third party because of the child support unit and his returns are not going to him they are being taken. Should they still be allowed to intercept his tax returns if the case was seen by a judge and his payment are being taken out weekly out of his check to pay off the amount he owes?
